Overview

This website, katycowan.co.uk (the “Site”), is operated by Creative Boom Ltd, a company registered in England and Wales with company number 07437294 and registered office at Suite 6, 19 Lever Street, Manchester, M1 1AN. References to “I”, “me” and “my” in these terms are to Creative Boom Ltd, through which Katy Cowan provides the Services. You can contact me at hello@katycowan.co.uk.

By using the Site, or by booking any of my services, you agree to these terms. If you don't agree with them, please don't use the Site.

Using the Site

The Site provides information about me and my work, and offers mentoring and consultancy services for creative professionals (the “Services”). You may browse the Site for your own personal or business use.

You agree not to:

•      use the Site in any way that is unlawful, fraudulent or harmful;
•      attempt to gain unauthorised access to the Site, the server on which it is hosted, or any connected systems;
•      introduce viruses, malware or other harmful material;
•      scrape, harvest or systematically extract content or data from the Site without my written permission, including for the purposes of training artificial intelligence models.

Intellectual property

Unless stated otherwise, all content on the Site – including text, articles, graphics, photography, logos and layout – is owned by or licensed to me and is protected by copyright and other intellectual property laws.

You may view, download and print pages from the Site for your own personal use. You may not republish, reproduce or commercially exploit any content from the Site without my prior written consent. If you'd like to reference or share something, a link back with credit is always welcome – just ask.

Any frameworks, notes, templates or other materials I create or share with you as part of the Services remain my intellectual property. You're welcome to use them freely in your own business and career, but you may not resell them, republish them or pass them off as your own.

The Services

I offer mentoring and consultancy services for creative professionals, currently including:

•      Strategy Session – a one-off session as described on the Site;

•      The Quarter – a three-month mentoring engagement as described on the Site;

•      Bespoke engagements – scoped and priced individually by agreement.

The description, scope and current price of each Service are set out on the Site or confirmed in writing before you book. All prices are stated exclusive of VAT, which will be added at the prevailing rate.

I may update the Services and their pricing from time to time. Changes won't affect bookings that have already been confirmed.

Booking and payment

You can book and pay for Services either:

•      through Calendly if opting for a Strategy Session, using the online checkout (payments are processed securely by Stripe – I never see or store your full card details); or
•      by invoice if opting for a longer-term package, where we've agreed this in advance. Invoices for The Quarter are payable upfront and, for anything bespoke, before each session, unless we agree otherwise in writing.

Your booking is confirmed once payment has been received (or, for invoiced bookings, once I've confirmed the engagement in writing). A booking confirmed by me forms a binding contract between us on these terms.

If an invoice remains unpaid after its due date, I may suspend delivery of the Services until payment is received, and I reserve the right to charge statutory interest and compensation on late business-to-business payments under the Late Payment of Commercial Debts (Interest) Act 1998.

Scheduling, rescheduling and cancellation by you

Sessions take place at a date and time agreed between us, usually by video call unless we arrange otherwise.

If you need to rearrange a session, please give me at least 48 hours' notice, and I'll happily reschedule at no charge. If you cancel or miss a session with less notice than that, I'll offer to reschedule it once as a goodwill gesture; if the rescheduled session is then cancelled or missed with short notice again, that session is forfeited.

The Quarter and bespoke engagements

The Quarter runs for three months from the agreed start date. The sessions and support included are intended for use within that period, and any unused sessions expire 30 days after the engagement ends unless we agree otherwise in writing.

Either of us may end The Quarter or a bespoke engagement early by giving the other at least 14 days' written notice. If that happens, I'll refund the fee for the part of the engagement not yet delivered, calculated pro rata – by sessions remaining where the engagement is session-based, and otherwise by time. This doesn't affect your statutory cancellation rights under clause 8, if you're a consumer.

If you stop responding or engaging for a sustained period, I'll make reasonable efforts to get in touch. If I can't reach you, I may treat the engagement as ended by you under this clause.

Your legal right to cancel (consumers)

If you are buying as a consumer (that is, mainly for purposes outside your trade, business or profession) and you book online or otherwise at a distance, you have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your booking within 14 days of the day the contract is made, without giving a reason, and receive a full refund.

If you'd like your session or engagement to begin within that 14-day period, you'll be asked to expressly request this when booking. In that case:

•      if you cancel after the Services have begun but before they're complete, you'll be refunded less an amount reflecting the Services already provided;

•      once the Services have been fully performed within the cancellation period at your request, the right to cancel is lost.

To cancel, just email me at hello@katycowan.co.uk within the 14-day period stating that you wish to cancel. You can use the model cancellation form at the end of these terms, but you don't have to. Refunds are made within 14 days of cancellation, using the same payment method you used.

If you are buying on behalf of a business, the statutory cancellation right above does not apply, and clauses 6 and 7 govern cancellation, rescheduling and early termination.

Cancellation by me

Occasionally I may need to rearrange a session – for example, due to illness or unforeseen circumstances. If so, I'll give you as much notice as possible and offer alternative dates. If we can't find a suitable alternative, I'll refund you for any Services you paid for but didn't receive. That refund is the limit of my liability for a cancelled or rearranged session.

What the Services are (and aren't)

My mentoring and consultancy draws on my professional experience in the creative industries. It is guidance and support to help you make your own decisions – it is not, and shouldn't be treated as, legal, financial, accounting or other regulated professional advice. You remain responsible for the decisions you make and the actions you take in your business and career.

While I'll always give you my honest, considered input, I can't and don't guarantee any particular outcome or result from the Services.

Confidentiality

Anything you share with me during the Services will be treated as confidential, and I ask the same of you in respect of any non-public information I share with you. Neither of us will disclose the other's confidential information except where required by law, or with the other's consent.

One carve-out: my mentoring work informs my wider writing, speaking and publishing. I may draw on general, anonymised themes and learnings from the Services – for example, in Creative Boom articles or talks – provided nothing identifies you or your business and no confidential information is disclosed. If I ever want to mention you by name (say, as a case study or testimonial), I'll always ask first.

Liability

Nothing in these terms excludes or limits my liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under English law. If you are a consumer, nothing in these terms affects your statutory rights.

Subject to that:

•      I am not liable for any loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss arising out of or in connection with the Site or the Services;

•      my total liability to you arising out of or in connection with the Services is limited to the amount you paid me for the Services in question;

•      the Site is provided “as is” – I take care to keep it accurate and available, but I don't guarantee that it will be uninterrupted, error-free or free of viruses, and content on the Site is for general information only.

The Site may link to third-party websites. Those links are provided for convenience; I have no control over, and accept no responsibility for, their content.

General

•      Changes to these terms. I may update these terms from time to time. The version of the Site in effect at the time you book applies to your booking.

•      Transfer. Neither of us may transfer our rights or obligations under these terms without the other's consent.

•      Entire agreement. These terms, together with the description of the relevant Service and any written scope we agree, form the whole agreement between us in relation to the Services.

•      Severability. If any part of these terms is found to be unenforceable, the rest continues in full force.

•      Governing law. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction – except that if you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings there, and you'll benefit from any mandatory protections of the law of the part of the UK where you live.

Accessibility

I want this Site to be usable by as many people as possible, and I make reasonable efforts to follow good accessibility practice. If anything on the Site is difficult for you to use or access, please let me know at hello@katycowan.co.uk, and I'll do my best to fix it or provide the content in another format.
